Terms of service

Effective date: 29 March 2026

These Terms of Service ("Terms") govern your access to and use of ListPic ("the Service"), operated by ListPic ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use ListPic.

1. Service description

ListPic is an AI-powered product photography tool designed for marketplace resellers. The Service uses artificial intelligence (Google Gemini) to transform product listing photos by replacing backgrounds with clean, studio-quality settings whilst preserving the original product exactly as it appears. ListPic modifies only the background, lighting, and composition of your photos — never the product itself. This includes preserving all creases, marks, stains, text, labels, and other details.

2. Eligibility

You must be at least 16 years of age to use ListPic. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Account registration

To access ListPic, you must create an account using Google authentication or email. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@listpic.app if you become aware of any unauthorised use of your account.

4. Subscription plans and billing

ListPic offers the following plans:

  • Free— 3 photo transformations in total, with a watermark applied to all output images. No payment required.
  • Plus (£4.99/month)— 50 photo transformations per month, no watermark, batch processing of up to 5 photos at a time.
  • Pro (£9.99/month)— 200 photo transformations per month, no watermark, batch processing of up to 20 photos at a time.

All paid subscriptions are billed monthly in advance via Stripe. Prices are stated in pounds sterling (£) and are inclusive of VAT where applicable. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

We reserve the right to change our pricing at any time. If we change the price of your current plan, we will provide you with at least 30 days' notice before the new price takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Cancellation and refunds

You may cancel your subscription at any time through your account settings page or via the Stripe Customer Portal. Upon cancellation, your paid plan benefits will continue until the end of your current billing period, after which your account will revert to the Free plan.

As a digital service, we generally do not offer refunds for partial billing periods. However, if you experience a significant service issue or believe a refund is warranted, please contact us at hello@listpic.app and we will consider your request on a case-by-case basis.

6. Your content and intellectual property

You retain full ownership of all photos you upload to ListPic and all transformed images generated by the Service. By uploading photos, you grant us a limited, non-exclusive, worldwide licence to process, store, and transform your photos solely for the purpose of providing the Service to you. This licence terminates when you delete your photos or your account.

You represent and warrant that you own or have the necessary rights to upload and process the photos you submit, and that your use of the Service does not infringe the intellectual property rights of any third party.

7. AI disclaimer

ListPic uses generative AI technology (Google Gemini) to transform your photos. Whilst our AI is designed and instructed to preserve your product exactly as it appears, AI-generated outputs may occasionally contain unintended alterations, including but not limited to:

  • Minor changes to text or lettering on products (e.g., brand names, labels, or tags)
  • Slight changes to product orientation or positioning
  • Subtle variations in colour rendering or fine surface details

You are solely responsible for reviewing all transformed photos before using them in marketplace listings. We strongly recommend comparing your original and transformed photos to verify that all product details, text, and features are accurately represented. ListPic does not guarantee the accuracy of AI-generated outputs and accepts no liability for listing disputes arising from unverified transformed photos.

8. Acceptable use

You agree not to use ListPic to:

  • Upload, process, or distribute content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
  • Upload sexually explicit, pornographic, or NSFW (not safe for work) content
  • Create misleading or fraudulent marketplace listings that misrepresent the condition, appearance, or nature of products
  • Attempt to reverse-engineer, decompile, or extract the underlying AI models, algorithms, or source code of the Service
  • Circumvent, disable, or interfere with usage limits, rate limiting, or any security-related features of the Service
  • Use automated scripts, bots, or other means to access the Service in a manner that exceeds reasonable use
  • Resell, sublicence, or redistribute the Service or access to it without our prior written consent
  • Use the Service in any way that violates applicable laws or regulations

We reserve the right to suspend or terminate your account without notice if we reasonably believe you have violated these acceptable use terms.

9. Honest listings

ListPic is designed to improve the presentation of your listing photos, not to misrepresent your products. Our AI modifies only backgrounds, lighting, and composition — never the product itself. You are responsible for ensuring that your listing photos, whether original or transformed, accurately represent the items you are selling. You must comply with the terms and policies of any marketplace platform on which you list your items.

10. Service availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our reasonable control. We will endeavour to provide advance notice of planned maintenance where practicable.

11. Limitation of liability

To the fullest extent permitted by law, ListPic and its operators, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Service.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total amount you have paid to us in the twelve (12) months immediately preceding the claim. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

12. Indemnification

You agree to indemnify, defend, and hold harmless ListPic and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time by deleting it through your account settings page. Upon account deletion, we will delete your personal data and photos in accordance with our Privacy Policy.

Sections relating to intellectual property, limitation of liability, indemnification, and governing law shall survive termination of these Terms.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a prominent notice on the Service prior to the changes taking effect. The "Effective date" at the top of this page indicates when these Terms were last revised. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

15. Governing law and disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
